Terms & Conditions

1.        Participation in this promotion is deemed acceptance of these Terms and Conditions.

2.        Information on how to enter and the offer are part of these Terms and Conditions.

3.        The promotion is only open to individual Australian residents.

4.        The promotion commences at 9:00am (AEST) 1 August 2014 and closes at 11.59pm (AEST) on 30 September 2014 (“Promotion Period”).

5.        To be eligible for the corresponding cash back, participants must purchase from Authorised Canon Australia retailer, any of the following Eligible products during the Promotion Period (“Eligible Claimant”) and submit a claim in accordance with clause 9:

6.        Only new (not pre-owned) Canon Australia products will be eligible.

7.        This promotion is not available in conjunction with any staff discounts available to officers and employees of the Promoter.

8.        Cash back amounts issued are in Australian Dollars inclusive of GST.

9.        Claims submission methods:

(a)             For purchases from Canon Australia’s online store:

During the Promotion Period, the cash back amount will be applied directly as a discount off the purchase price and finalising the purchase will be deemed to be submission of a claim.

(b)             For purchases from a participating Authorised Canon Australia retailer:

Eligible Claimants must:

(i)     visit canon.com.au/claim; 

(ii)    input the requested details including full name, a valid email address, bank account details if the Eligible Claimant wishes to receive the cash back via electronic funds transfer (EFT) and submit the fully completed online claim by 11.59pm (AEDST) 30 October 2014; and

(iii)  mail a copy of the tax invoice (proof of purchase) together with a printed copy of the claim form to “Canon Cashback, PO Box 710, Eastern Suburbs MC, NSW 2004 in time to be received by last mail on 30 November 2014.

10.     Failure to produce the proof of Eligible Purchase when requested by the Promoter will result in the invalidation of that claim and the forfeiture of any right to a cash back.

11.     Payment methods:

(a)             For purchases from Canon Australia’s online store:

The cash back amount will be issued to the Eligible Claimant automatically in the form of a discount off the item purchase price at the online store checkout webpage.

(b)             For purchases from a participating Authorised Canon Australia retailer:

Cash backs will be paid to the Eligible Claimant named on the claim form within 30 days of Canon verifying the claim by way of a non-negotiable cheque OR electronic funds transfer (EFT). It is the responsibility of the participant to provide correct details. Delays and non-payment of claims that arise as a result of supplying incorrect name or address are the responsibility of the participant to be accepted as a condition of participating in this promotion. Cash backs are not transferable or assignable. Any bank transaction fees associated with the clearance of the cheque is the responsibility of the Eligible Claimant.

12.     Eligible Claimants may submit more than one claim provided: (a) only one claim is submitted for each Eligible Purchase; and (b) each claim is submitted separately and in accordance with these Terms and Conditions.

13.     Canon Australia’s network of authorised distributors, dealers and retailers form the “Canon Australia Distribution Channel”.  Canon-branded products, whether new or used, that have been sourced by end-users, distributors or retailers from any source other than through Canon Australia and the Canon Australia Distribution Channel (including  ‘grey’, ‘parallel’ or ‘direct’ imports) are not Canon Australia products and therefore would not constitute Eligible Purchases. 

14.     The Promoter reserves the right, at any time, to verify the validity of claimants (including contacting the place of purchase) and to disqualify any claimant who submits a claim that is not in accordance with these Terms and Conditions or who tampers with the claim process.

15.     Incomplete, indecipherable or illegible claims may be deemed invalid, although errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

16.     No responsibility will be accepted by the Promoter for late or misdirected claims.

17.     The Promoter’s decisions are final and no correspondence will be entered into.

18.     If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any participant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.

19.     Any cost associated with accessing the promotional website is the participant’s responsibility and is dependent upon but not limited to the telecommunication provider and internet service provider used.

20.     The use of any automated software or any other mechanical or electronic means that allows a participant to automatically claim repeatedly is prohibited and will render all claims submitted by that participant invalid.

21.     Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence) for any personal injury or any loss or damage (including loss of opportunity) - whether direct, indirect, special or consequential - arising in any way out of the promotion, including (without limitation): (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any claim or gift that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in cash back value to that stated in these Terms and Conditions; (e) any tax liability incurred by an Eligible Claimant; or (f) use of the cash back.

22.     The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, suppliers and as required, to regulatory authorities. Participation is conditional on providing this information.

23.     This promotion is governed by the laws of New South Wales.  The Claimant and Promoter submit to the nonexclusive jurisdiction of the courts of New South Wales and the Federal Court of Australia and any courts that may hear appeals from those courts about any proceedings in connection with these terms and conditions.
